Refund Policy

Scope of Policy

This Refund Policy ("Policy") applies to all purchases made through Aussie Night Markets Pty Ltd, including but not limited to Vendor Fees and Other Service Payments.

No Refunds for Vendor Fees or Change of Mind

  • All stallholder/vendor fees are strictly non-refundable.

    • This includes situations where you are unable to attend an event, arrive late, or choose to cancel your participation.
    • No refunds will be provided if an event is canceled or rescheduled due to unforeseen circumstances, including but not limited to weather conditions, safety concerns, venue issues, or other factors beyond our control.
    • By registering as a stallholder or vendor, you acknowledge and accept this no-refund policy.
  • No refunds are available for change of mind, incorrect selection, or if you find the same service at a lower price elsewhere.

Australian Consumer Law Compliance

Aussie Night Markets Pty Ltd adheres to the Australian Consumer Law (ACL) and provides refunds only where consumer guarantees apply.

Under the Australian Consumer Law, you are entitled to a refund or cancellation only in cases of major failure, such as:

  • The service provided is substantially unfit for its intended purpose and cannot be remedied.
  • The service does not match the description advertised.
  • The service was not delivered as agreed, and we are unable to provide a reasonable alternative.

If the issue does not constitute a major failure, we may provide an alternative resolution at our discretion, such as re-scheduling or credit towards a future event.

Exceptions to Refunds

We may refuse to provide a refund if:

  • You change your mind after booking.
  • You fail to attend an event or service for any reason.
  • You breach the terms of our agreement (e.g., failure to comply with stallholder rules).
  • The issue does not qualify as a major failure under Australian Consumer Law.

Processing Time for Refund Requests

  • All refund requests (where applicable under Australian Consumer Law) will be processed within 7 business days of approval.
  • Refunds will be issued using the same payment method as the original transaction.

How to Request a Refund (If Eligible)

To request a refund (only where applicable under Australian Consumer Law), you must:

  1. Email us at sales@aussienightmarkets.com.au with your purchase details.
  2. Clearly outline the reason for your request and provide any supporting evidence.
  3. Await further instructions from our team.

Aussie Night Markets Pty Ltd reserves the right to assess each request in line with Australian Consumer Law and our No Refund Policy.
